crappy house

I bought a house in october of 99 and the company that we bought it from didn't follow through with the contract and it says that if they don't follow through with the contract they will take over our mortgage and we were just wondering if we should file a big lawsuit or just small claims

I need more information before I can answer this. What did they not follow through with? Why do you want them to take over your mortgage - are you abandoning the house? What happens if they "take over your mortgage" and don't pay?
