Legal Question in Consumer Law in Utah

Foreign objects in food

I purchased a bag of beef jerky. I do on a regular basis. But I took a bite and chomped down on a piece of bone, about the size of a dime. It hurt my teeth a little but not any real damage. Can I take any legal action?

In order for a person to sue for damages there must be some demonstrable injury. In your case you have sore teeth. How much money would a jury give you for your sore teeth? If you had broken teeth, which resulted in $5000 of dental bills, then your damages would have been $5000 plus the time off work, and something for general pain and suffering. In your case it is just sore teeth. I doubt that a jury would be sympathetic enough to award you much - maybe a dollar (symbolic damages). I do suggest that you contact the jerky manufacturer and let them know of the problem.
