Mail ordering fraud

Puirchased an expensive watch from a website merchant, when received parcell package the item in the box was not the watch I had ordered,Instead it was a cheap used watch, as if someone tampered with the package and replaced it.

Amex card was used in purchasing this watch however my dispute noted with Amex went unsucessfull with the Watch merchant. Merchant still wants me to pay for merchandise that I did not recieve.

What are my rights?

Ps I reside in new york and merchant is in Utah..

It depends on the terms of the agreement between you and the merchant. Generally the seller maintains ownership of the product until it is delivered. The seller is responsible for the materials during shipping,unless you made another agreement. You may have to sue the seller.
