I wrote an $1800 check to a physician for a procedure as ''good faith'' incase the insurance didn't pay. When I found out the insurance was never billed I put a stop payment on the check. Unfortunately, the dr deposited the check before the stop pmt and an NSF occured. The dr turned the check to a colleciton agency who tried to get me to pay $3600 - it is on my credit report. Meanwhiile, I asked the dr to please try billing my insurance as per our original. They did, 8 months later, and received a pmt for $699, which is the max allowable by my insurance per the contractual agreement between the dr and the insurance company. The dr's office said they'd contact the credit bureau to resolve and remove the collections account, since the account was ''satisfied.'' However, the collection agency is still trying to take this to court and claims they have a right to collect on the check. Help! What do I do?

Re: Nsf

Pressure the Dr to get the case withdrawn. Otherwise if the collection agency remains adamant, you may want it to go to court to get resolved.
