Legal Question in Consumer Law in Utah

promised financing & now expected to pay mileage

We purchased a car on 4/26/03. The dealership did not get us financed after two months of us having the car. They now want us to pay for the mileage on the car. Are we required to pay this even though we were promised financing? Also, if you purchase a used car and decide you don't want it, how many days do you have to return it?

Re: promised financing & now expected to pay mileage

You probably signed some papers related to the financing. There should be some provision there for what you are charged if financing is not completed. That is the amount you owe the dealership. If there is no such provision, then the dealership bears the loss. However, in fairness, you had use of the car for 2 months, and it may be reasonable to expect you to pay something for its use.

If you purchase a vehicle and later decide you do not want it, there is no law that gives you the right to return it. Once you sign the papers, the car is yours. If you do not pay, you can be sued for the loss to the dealership.
