Legal Question in Consumer Law in Utah
Sueing for another down payment
We bought a used vehicle over a year ago. We were served papers for small claims court a couple months ago stating that we owed $1500 to the dealer for a down payment. With no proof of wheather we owed or not we just made an agreement to pay $100 a month. Looking back now and reading my sales contract it plainly states that all down payment was paid in cash and none of it was loaned. The dealership is stating that we were supposed to get a personal loan or to sign a promisary note that we would make payments to them. Is there anything you would suggest as to how We can get out of this deal?

The contract governs the terms between you and the dealer. Without seeing the contract, there is now way to know what the terms are and what your obligations and options are. You are welcome to call for a free consultation.
