Legal Question in Credit and Debt Law in Utah
Need Advice Please
My son recently discovered 2 credit card accounts on his credit report that were not his.They turned out to be accounts my husband had opened for us.(They both have the exact same first, middle and last names.)In the past there had been several accounts listed on my son�s credit report that were my husband�s--one was a car loan and the other two were parent plus student loans. It took forever but the loan companies finally admitted that they had made a mistake and took them off.So we really didn�t think it would be any different with these 2 accounts.The real problem is,one of the credit card companies has contacted my son and has given him some conflicting information.They say the account was opened under his social security number and was opened in 1998.This can�t be true because my husband died in 1996.Also, my husband would never have opened an account using someone else�s social security number.They talked my son into filing a fraud claim.Because I have continued to use the cards, it leaves me holding the bag and I�m afraid they will hold me responsible somehow.I�ve never been involved with anything like this before and I don�t know what to expect next.Can you please help?

At this point you need to get involved with your son and trace down the credit card applications and account information. It may take some effort, but in order to solve the possibility of a future problem you must get this straightened out. You may want to close these accounts and start over with a different account.
You do not need to fear any fraud charges, especially if you pay the bill. Few credit card companies do anything about fraud other than close the accounts. If you can't get the problem resolved, pay off and close the accounts.
