Legal Question in Credit and Debt Law in Utah

Attorney fee collection

I hired an attorney to represent me in collecting back daycare from my child's father. The agreement I signed says I only had 15 days fromt the date of the invoice to dispute charges. I was charged thousands of dollars for preparing the case for tiral. After 3 years of promises the attorney has refused to file the lawsuit until I pay $17000, so I asked her to resign. She is now threatening to send me to collections after I offered to make payments. Do I owe her fees for a lawsiut she worked on and didn't file. Am I responsible for not filing a dispute in writing in the 15 day timne frame if I didn't know at that time she wasn't going to file it? Also the agreement stated and hourly rate of $150 per hour and that only could be changed if all parties signed a new agreement, no notice was given and she started charging me $175 per hour. Do I owe for the larger amount because I didn't know I had to dispute within 15 days even though she has clearly not followed her own contract?

Re: Attorney fee collection

You can dispute the charges at any reasonable time. You do not have to pay for a higher hourly rate if the agreement does not allow for the increase. You can contact the Utah State Bar Association and file a fee dispute claim
