Legal Question in Credit and Debt Law in Utah

bad credit due to ex spouse

I recently discovered that I had a judgement on my credit report that was a debt of my ex husband's.. I was not notified in any form of this debt prior to it going to court, nor after the judgement. As a result my credit rating has plummeted and I find myself in a situation where my house is for sale but I am no longer sure if I could even qualify for another loan when it comes time for me and my new husband to relocate to another state. I have court documents stating that I am not responsible for his debt but I am told none of this matters. The debt has since been paid and I am not concerned about getting the money back, what I want is my credit rating restored. What can I do?

Re: bad credit due to ex spouse

File a statement with the credit bureau explaining that the judgment was your ex-husband's obligation from the divorce. Send a certified letter to the credit bureau(s) demanding that they remove the adverse report with a copy of the divorce decree.

The judgment entered against you was not valid unless you were served copies of the complaint. you might be able to go back to court and have the judgment amended if you can show you were never served (not an easy task). If you reversed the judgment it would come off of your credit.

A single judgment will not make it impossible to get another home loan.
