Legal Question in Credit and Debt Law in Utah

Calling and threating

Yes I have several collectors calling my personal and work phone wanting money from me. I have informed them that I am having finacial hardship right now and that I could not pay them anything. Yet they still are calling me every day four and 5 times a day or more. Now they threaten to come to my place of employment and talk to me. After I have informed them that I can't recieve phone calls or vistors at work. they have already got me into trouble with my boss once already. I have talk to them and I get sick of repeating myself to them over and over and telling them the same info. So I quit answering my phone and wont return their phone calls. Can they do that to me? Is there any way I can fight them on this or for the haressments. Please I need help.

Re: Calling and threating

There is a law called the Fair Debt Collection Practices Act, which regulates what collectors can do. They can call once a day, cannot call employers if told that creates a problem. Each call must begin with "This is an attempt to collect a debt, any information supplied will be used for that purpose." They cannot make threats which they do not intend to carry out - such as visiting you at work. All of these violations may be considered separate violations, which are punishable by up to $1500 in fines (each) and the cost of your attorney fees.

You can also send them a letter telling them to only contact you by mail. (Send the letter by registered, return receipt, also a copy by regular mail. Keep a copy for yourself.) If they call after they receive the letter, it is another violation.

If you want to take action, you may call me for further free consultation.
