Legal Question in Credit and Debt Law in Utah
Get Car Back For Non-Payment on Loan
I co-signed on a car loan for my daughter. She has quit paying for the loan and I am unable to locate her. I am making the loan payments but would like to know if there is any re-course I can take to get the car from her and sell it (provided I can even locate her). Both of our names are on the loan and the registration. Could I sue her for breach of contract with me?

Re: Get Car Back For Non-Payment on Loan
If your name is on the title you are legally entitled to possession, and can take the car (if you can find it.) You can probably sell it as well, depending on how the title is listed. If it says 'daughter' OR 'parent' either of you can sell it. If it says 'daughter' AND 'parent' both should sign. You should be able to get a court order allowing you to sell it, if you cannot sell the car outright.
