Legal Question in Credit and Debt Law in Utah

Collection Fees?

Last year I went to a dentist. I had insurance at the time. I explained to the ''staff'' that I only wanted work done that my insurance would cover. I left with the impression that I owed them nothing. 9 months later I recieved a ''bill'' from a collection agency for around 450 dollars. I never received a letter from the dentist. I first called the dentist who told me my insurance did not cover 325 of my bill. Apparently, at the bottom of the form I signed, I am responsible for these fees. I can actually except that in this day and age. The dentist told me they did mail me a bill. I guess legally they are in the clear even though I did not receive anything. They had my phone number they could have called...legal but unethical. My real disput is with the C.A. When I asked about the extra $125, they told me it was interest. Can a C.A. charge fees outside of the original debt. I had a hard time understanding the FDCPA.

Re: Collection Fees?

The dentist's agreement must require you to pay interest, otherwise the collection agency cannot charge it. If they did, they are in violation of the FDCPA.
