Legal Question in Credit and Debt Law in Utah

collection vs small claim court

My ex-friend borrowed money from me and does not pay it back.

As I understand, I have 2 options:

1) collection

2) small claim court

Collection, as I understand, they put it on credit report and it stays there untill the debt is paid.

how about small claim court? what if I go to court, but she still does not pay me back even if the judge says she should... How it will affect her? Will they put on her credit report? Or what...?

Which way do you think is better to use to collect the money?

Thank you so much in advance

Re: collection vs small claim court

You sue in small claims court. If you win you get a judgment. Then you can garnish wages, bank accounts, attach property, foreclose etc.

Collection usually means to send to a collection agency who takes a percentage of the amount recovered. Few collection agencies will collect for an individual without a judgment.
