Legal Question in Credit and Debt Law in Utah
How to contest a balance
I had a 6 month lease with an apartment complex which I did fulfill according to the lease agreement. I put in my 30 day notice and left when my lease was up. I received a bill for 100$ for carpet damage. They said the carpet was frayed and beyond repair. It was not damaged at all! I am the one that cleaned when I left and there was absolutely no damage. My friend cleaned with me and he is willing to witness to that. I talked to the district manager and she was beyond rude and said she will hold me to that balance yet they refuse to show me any proof. They say they have pictures and they won't show them to me. She also said the maintenence guy said he thinks it was my black cat that he always saw in my apartment. I never had a cat! I had a kitten for one day and it died the same day I got her, which I have proof of. If I don't pay the balance in 6 days it will go to collections. How can I contest this balance correctly?

Suggest informal mediation, then go to conciliation court if you can't get them to mediate. Did they take your deposit or are they asking you to pony up the $?

Three choices: 1) See if the apartment management has any sort of appeals process, or talk to a higher manager or owner; 2) let it go to collections, and when you get your notice send a letter to the collection agency and contest the debt and ask for proof; 3) take the initiative and sue the apartment management.
