Early Termination Fees

If a merchant posts on their website that they have a fee for early termination of service, but they do NOT send this in writing to the customer, is the fact that the fee is posted on their website, sufficient for them to bill the customer?

It depends on all of the language in all of the agreements. If it is referenced in other agreements, then it is probably enforceable.
