Legal Question in Credit and Debt Law in Utah

Ex-Spouse Stolen Credit Card

About 5 years ago my wife and her boy friend at the time opened a Credit account together. They never married and broke up over two years ago. About 4 months ago he supposedly had his card stolen and things charged to it. The signatures on the receipts were his. He told her 5 days later that it was stolen and she called in immediately but it was too late. They are now trying to get the money out of her. The name signed on the card had his last name and they were never married. She never signed application and they didn't ask for any ID with the application. The credit company will not take her name off the card since there is now a balance. What can She do?

Re: Ex-Spouse Stolen Credit Card

Tell the collectors that you require proof of the debt she owes, including copies of the account applications and receipts from purchases. Do all of this in writing - and re-notify them of the alleged theft.

Tell the boyfriend about your thinking that he may have committed fraud and that you will pursue it if he does not take care of the debts with the credit agency.

In the end, you may have to pursue this in court to get the credit agency's attention.
