Grace Period and being harrassed

Hi, my husband and I have a second mortgage on our home with a local bank. The payment is due on the 20th of each month and we have a 10 day grace period. On the 21st, if the payment hasn't been made, we start getting collection ''courtesy'' calls from the bank. We plan to make our payment each month within our grace period. So far this week, they've called our home 15 times. They claim the payment is late after the 20th regardless of our grace period. What are our rights regarding this harrassment?

As long as it is bank employees calling you have virtually no rights under Utah or Federal law. If the calls come from a 3rd party, such as a collection agency, you have rights. The bank is correct in that the payment is late after the 20th. The fact that you have a grace period does not mean your payment is not late. You should be aware that the bank can list your payment as 30+ on your credit rating, which although not severely adverse, is still a late payment.
