Legal Question in Credit and Debt Law in Utah
Is my husband responsible for my debt?
I have a credit card that is in my name and my husband was able to use it but did not go through a credit check to get his name on the account. I have a judgement against me now, and the Lawyer for the credit card company wants all my husbands information like social security number, place of work etc. Do I have to give that to them? I feel since my husbands name was not on the card why is he liable for my debt?

Re: Is my husband responsible for my debt?
If you approved your husband to use your credit card to the card company, the terms of the agreement between you and the company determine whether he has liability. Some credit card agreements state that any use may be liable for the debt, others restrict liability to the applicant. Tell the attorney that you want to see a copy of the credit card agreement that you signed, and for him to show you where that agreement makes your husband liable for the debt.
