Legal Question in Credit and Debt Law in Utah
Illegal collection practices
I received a letter from a collection agency for a three year old debt. I wrote the collector denying the debt within the thirty day window. A few days later I refeived a call from a collections attorney demanding payment. By law, 30 days have to be satisfied while under investigation. A few weeks later, I was served a summons. What do I do? They broke the law by not abiding by the 30 day grace period for investigtion. Am I compelled to reply to the judge/clerk/courts?

Re: Illegal collection practices
You must respond to the summons and complaint. Deny your liability for the debt in your answer. The plaintiff will have to prove you owe the money. You may be able to counter sue for violations of the Fair Debt Collection Practices Act
