Legal Question in Credit and Debt Law in Utah
Leins
There is a person (Party A) who owes money to another (Party B). A promissory note was written and the terms were not fulfilled by Party A.
Can Party B place a lein on Party A's home for the amount owed? If so, what is required to do so?

Re: Leins
Not unless the note allows for a lien to be filed. TO get a lien, Party B will have to obtain a judgment through a lawsuit. Once judgment is filed, it becomes a matter of record, and the judgment holder (Party B) can garnish wages, accounts or property, including real property.
