Legal Question in Credit and Debt Law in Utah
Non exempt property
What is non exempt property? I have a judgement for an unpaid medical bill they are taking me into court for supplemental proceedings to answer questions about my non exempt property. We are also thinking of getting a title loan on our car this week is this considered going against the court order? It says to restrain defendent from sell, loan or giveaway or dispose of said property. Would I get into trouble if I did a title loan?

Re: Non exempt property
Utah law exempts certain property from seizure by a creditor. Exempt property includes income up to minimum wages, retirement accounts, necessary household and clothes, tools if you are a tradesman, and others. You may not borrow against your car without permission of the court. Talk to the creditor's lawyer. He might agree to let you do that if you give him all or part of the proceeds. You may want to talk to a bankruptcy attorney.
