Legal Question in Credit and Debt Law in Utah

NSF check maximum fees

I paid return check charge and collection of $40.00 on a $500.00 returned check. The now want $750.00 penalty and $50.00 legal fees for a total of $1340.00 or they threaten to file suit. Is this excessive amount legal to collect in the state of Utah?

Regards,

Dennis

Re: NSF check maximum fees

You have 15 days from the date of notice to pay the NSF check and fees of $20 plus collection charge of $20. If not paid within 30 days, then the collector can offer to settle. After 30 days you are liable for three times the amount of the check up to $1500.

If you have paid the collector or the merchant, and they have accepted and cashed your remittance, the fees and make the check good, then they cannot collect more.
