Do I Still Owe?

I purchased a piano from a local music store. put 500.00 down and the piano was to be delivered in 2 or 3 weeks with ballance due. It was delivered and set up. After 2 or 3 days I found that the new piano had a split in the sound board. I called the store to tell them of the defective piano. Also to mention the damage to my house when they move the piano in. We went over some options of upgradeing or getting a replacement. The replacement was the plan. He said it would take a few weeks. I basicly was told tuff about the dammage to my door frame. about 4 months later, not even a call. Then apx 6 months later I get a call that said they had a replacement piano for me, At this point I said just forget it. Ill keep the one we have after all this time. anouther month goes by and now the call comes saying pay up, we forgot about the bill. Do I still have to pay?

You are required to pay for the value of the piano with the split sound board, less the cost to repair the damage to your house from their movers. Get some estimates of the retail value of your piano with the damage to it - or perhaps get prices to repair the damaged board, and deduct that price from the original cost. Then get a price to repair the damage from moving in the piano and also deduct that from the purchase price of the piano. Get prices in writing. Be prepared to go to small claims court to sustantiate your claim if the seller does not agree.
