Legal Question in Credit and Debt Law in Utah

Payment start date on contract is wrong.

The first installment of payments on my contract is dated to start Nov. 25, 2004 1 year later than it should have been. Is the creditor obligated to uphold the date listed since it was an error on there part and was signed by myself and the office representative? This is an actual contract for orthodontic services, and has set fees precisly listed. Would this even hold up in a court?

Re: Payment start date on contract is wrong.

THis is a clerical or typographical error. From your words it was not a misunderstanding, but a simple mistake. Since neither you nor the dentist intended for the contract to start in Nov, you would be held to the original date. Since you knew it was to start earlier, it would show good character on your part to honor the actual agreement.
