Legal Question in Credit and Debt Law in Utah

personal journal

My daughter and I were taken advantage monetarily by a ''boy'' going to BYU University. We are trying to go through ''small claims court'' for reimbursement of funds. My daughter had a personal journal that he will not return. I tired to file in small claims court for the sum of $2000 along with the other amounts and I am willing to give credit for the items returned in good condition for the full sum being charged. When my daughter tried to file, the court said we had to contact an attorney to find out if we could charge the sum.

Re: personal journal

Small claims is intended for the collection of monies less than $5000. If you have the right to claim $2000 then go for it. You might try getting an order of the court ordering the boy to return the dairy as well, but you will need a request for money to get to court. Otherwise you will probably have to go to district court. You may also want to contact BYU honors. They have power to encourage the boy to return your property on peril of expulsion.
