Legal Question in Credit and Debt Law in Utah

Putting a lien on someone's property.

I went through a divorce a few years ago and I am trying to clean up my credit report. I have joint records on my ex-husband. I have asked him for payment on half of the unpaid bill but he is unwilling to pay. How can I file a lien on his property for unpaid bills?

Re: Putting a lien on someone's property.

Your divorce decree should have provided for a division of debts. If it did, then you can file an order to show cause why your ex should not be held in contempt of court for failing to pay his portion. If the decree did not contain a division of debts you can file a petition to amend the decree to divide the debts. You cannot unilaterally file a lien against his assets without a court order.
