Legal Question in Credit and Debt Law in Utah
Retirement funds
My wife is in the U of U medical center for mental illness. when they release her, they want to put her in a nursing home. I have a home, and a retirement check comes once a month from mutual funds that I placed my 31 T retirment package in. I also get 1100.00 social security. I can in no way afford a home to take care of my wife. Can the hospital attach my home and retirement check ? What options do I have ?
Thank you
Dennis

Re: Retirement funds
If your wife is a joint owner of your home, the state (or Federal) agencies can attach her interest in the home. In some cases, the home can be sold. If you want to explore options to preserve your home, you should visit with an attorney. Your income should be exempt from attachment, however, until you visit with an attorney about your particulars, you will not be able to get a complete answer. You should speak with someone familiar with elder law and estate planning.
