Legal Question in Credit and Debt Law in Utah

My Rights in UT

I am being taken to court for an old furniture bill I neglected to pay. It was bought (I think) by an adjustment bureau. The original amount I owe is 3500.00 and now its 14000.00 and I called to see if we could work something out but was told I have to pay the full amount. I am currently trying to pay off these old bills and most of the companies have worked with me and were willing to cut the amount in half and take payments, which I am making monthly. I know I have to go to court or there will be a bench warrant issued for my arrest. I am currently unemployed and receiving benefits that amount to 1200.00/month. What are my rights and what should I say when I appear in court? I want to tell them to...well you know, but I would never do that. But, I also am not willing to pay these sharks 14000.00 it's absurd. Thank you very much

Re: My Rights in UT

1. You can make the plaintiff prove that you owe the requested amount.

2. You can claim that the amount is not reasonable, and ask the court to lower it. You should have evidence.

3. You can file bankruptcy.

Note, the plaintiff's attorney will appear at court and may be willing to make a deal there.

Note 2. You can avoid garnishment of your wages for amounts greater than minimum wage (about $1200).
