Legal Question in Credit and Debt Law in Utah

Statute of Limitations on collections

I have had a collection agency pop up out of no where wanting to collect on a debt from 5 years ago.

My understanding is there is a 4 year SOL on the ability to collect on credit cards, no matter how many collection agencys it has gone through. It goes back to the the original date of default. They are threatening me with a judgement ( I have not personally talked to them). How do I address this, so they will leave me alone? Do you have any sample letters I could submit or look at. I'm In Utah.

Thankyou, I appreciate your time.

Re: Statute of Limitations on collections

You are still liable on the debt - and can be for up to 10 years. A judgment does not happen until they sue you first. You may want to negotiate a settlement - make sure that they agree in writing to not file a negative credit report.
