Legal Question in Credit and Debt Law in Utah
submittance of false information to credit bureau
I leased a truck from GMAC(1999-2002).
I returned the truck several months early(voluntay repo?).
GMAC Submitted a bankruptcy on my credit report to the credit bureau.
I have never declared or filed in any way for bankruptcy.
I found out about it when I tried to buy a house and lenders wouldn't finance me because of my credit report.
I don't have that report. it is a year old.
do you know how I go about finding the information I need to slap GMAC on the wrist?
thanks--name removed--

Re: submittance of false information to credit bureau
You can get a copy of your credit reports either on line, or from the credit reporting agencies. Before you take any action you should verify what your credit report contains.
Contact the credit reporting bureau and file a complaint contesting the information submitted. Request a verification of the report. Also contact GMAC and demand that they submit a corrected report.
HOWEVER, you should be aware that when the vehicle was returned that it was sold at auction. You probably owe a deficiency on the vehicle, meaning that they sold it for less than you owed on it. GMAC now may come back against you for the deficiency. When they listed it as a bankruptcy GMAC assumed you had filed and are not trying to collect.
The corrected report will also be a severe negative report on your credit. You will have to decide which is the worse - a falsely reported bankruptcy, or the risk of collection on the deficiency along with a negative credit report.
