Legal Question in Credit and Debt Law in Utah

Sue for loss of loan?

If I am denied a loan based on an inaccurate delinquency on my credit report, can I sue the creditor who submitted that inaccurate information for the amount of the loan? The creditor knew I disputed the charge and submitted the delinquency anyway after several months of no communication. I can prove the information is inaccurate so that my credit report should eventually be corrected, but it will take time and I have already been harmed by the loss of the loan. To make me ''whole'', can I receive compensation for that loss?

Re: Sue for loss of loan?

You can sue, and will have to show that the creditor knew or should have known that the debt was in error. It is not enough that it was disputed. If the creditor has a good faith basis for the report, you will lose. You have to show the creditor intended to file a false report.
