Getting sued by credit card company

Hi,

My wife is getting sued by a large credit card company. She does not work, or have any assest worth speaking of. Her checking account does not have much money in it either. The judgement has been awarded to the bank who is using an aggressive attorney here locally. My wife has been asked to come to court and ask some questions on assets. Then the lawyer sent a letter saying if she does not want to come to court, she can call him and ask questions over the phone. Then if he feels the questions were answered honestly, then he would cancel the court hearing. What kind of questions is he going to ask, and legally what does she have to answere?

Apparently there is a judgment against your wife. She must either cooperate with the attorney or appear in court, there to answer questions about her assets. She will be asked about savings, income, checking and other financial accounts along with property she may own or in which she has an interest. The attorney is looking for money or something which can be used to satisfy the judgment amount. Note if you own a house together, the judgment can be filed against her interest in the house, so if you sell the house, you may have to pay the debt.
