summons debt collection
I received a summons from the attorney of a debt collection agency. It is regarding a returned check for 31.96. Reportedly the collection agency sent me a letter requesting the payment. To the best of my knolwledge I did not receive the letter. The summons was the first notification I received. The summons requires that I pay $423.00. Is there anything I can do to influence the judge to lower the amount?The summons says it is pursuant to utah code section 7-15-1 (7)(b)(iv). It includes pursuant to Utah R Civ p. 73 (2005) for interest, legal fees, court costs,etc. I do not dispute that I need to pay the returned check but is there anyway to have the amount lessened or am I stuck due to the code.

You can always call and discuss a settlement for less. Your other choice is to answer the summons and go to court and convince the judge you did not get the proper notice.
