"how much time do you have to answer a summons?"

"I have a question. When you are serve a summons, how much time do you have to answer the summons before it is actually filed.

The reason is I was served with a summons 13 days after it was filed and a judgment had already been rendered against me and I didn't even know when I was supposed to appear in court. Do I have any chance of getting the judgment reversed or what?

Please let me know."

How is it that you didn't receive it until 13 days

had gone by ... when was it actually delivered to your

address? Were you out of town or something?

In general, for the reason you just gave, default

judgments are easily vacated. Under federal rules

it falls under Rule 60 and it MIGHT be the same in

your state, I don't know. But you have to act fairly

quickly now that you've found out about the judgment.
