Legal Question in Credit and Debt Law in Utah
My wife was served papers on a returned $7 check. The check was returned but we couldn't find anything that was mailed to us and had zero phone calls. The Attorney now wants $412.
$7 principal, $15 court papers, $100 damages, $20 collection, $20 check fee, $250 attorney fees
I don't know what to do... Can I fight this in court?

Contact the payee and see if you can negotiate directly with them. Otherwise you will have to negotiate with the attorney's office. Note: although the letter is from an attorney, the people doing the collection are just collectors, they are not themselves attorneys. You can negotiate for lower fees. If there is a bona fide reason you did not get the notices, you can fight in court. However, if you moved or the address on your check does not match your current address you will have a problem.
