Legal Question in Credit and Debt Law in Utah

Will I go to Jail?

We recently lost a judgement for a repossion of a car they told us we had to pay $50.00 a month we did up untill about 2 months ago when my husbands job couldn't pay him he is a sub contractor and unfortunatlly has no income coming in we are having family pay our rent until things get better. Well we just got served continuance papers or a form E and I know that if we do not show up we will loose. What I want to know is if they can't garnish our wages and we have no assests can they put us in jail? I am not sure what we are suppose to do we are in a rock in a hard spot. By the way we got served today which is June 10,2002 and the court date is for June 11,2002 about 5 hours from where I live so there is no way I will be able to make it so I will loose.

Re: Will I go to Jail?

Call the court to make sure the hearing was held. You are entitled to a reasonable notice before court, and one day is not reasonable. You can have any judgment set aside. You cannot be put in jail. If you have no money, they will have to wait.
