Will I win if I go to court, or should I pay the attorny that is bothering us?

My husband wrote a check to the school for $100. It bounced, and we've gone in to pay fee's in person since then. We recently recived documents from a lawyer saying we need to pay $400 today or we are going to court.

We have not recived any thing from the school, or from a collection agency. The school has sent the letters to the address on the check. That is not our current address. (we are listed in the phone book) If we go to court would it be possible to only pay the $100, or would we lose and have to pay all of the attorney fee's and collection agency fees. Please help give me an idea. Thank you.

1 Go to the school and try to pay them. They can recall the check from the lawyer.

2. Lawyer is more of a collection agency than lawyer. You can negotiate with the the collector for the amount of the fees. The law only requires them to sent notice to your check address. They can then collect the bad check fee and "costs of collection" which are negotiable.
