Legal Question in Criminal Law in Utah
When I was 11, my best friend who was 12 and much more mature than myself pinned me down and attempted to rape me, however, his penis never actually entered my anus, just slightly between my buttocks. I was terrified, and couldn't move. Was this a crime? Obviously we are both male, and supposedly straight, I am for certain, but am confused about his behavior at that time. This took place over 35 years ago, so I'm certain that the statute of limitations has run its course. Thank you for your time!

State law permits charging defendants with inchoate--or incomplete--crimes, such as attempted rape. As a defense attorney, I'm hesitant to say that any fact pattern is or is not a crime, but people are charged with "attempted" crimes all the time.
