Legal Question in Criminal Law in Utah

My 24 year old daughter is in the state of Utah. She went to jail last June for child abuse/neglect. (She slapped her childs face and left a handprint) She has spent a year in jail for this offense. She recently was released and then put back into jail for violating probation (drinking a beer).

I know that none of this looks like a model citizen. But, she was wanting to go through "drug court" and counselling. Now, the judge told her that she can spend another year in jail if she does not go through counselling which she cannot afford.

My question is: Can this judge give my daughter another year in jail when she has already served the one year that was her original sentence?

Without knowing the details of her offenses there is no way to answer your question. However, she should obtain legal assistance.

BTW she can get counseling at little or no cost through the county mental health clinics in many counties.
