Legal Question in Criminal Law in Utah
So I was caught shoplifting from wal-mart on dec 31st of 09 i'm still on probation for it and stupidly I tried it again today with a couple cans of soda and was again caught (while still on probation) The officer I was talking to told me that I most likely would not face jail time is that true? Trust me I feel horrible and I have learned my lesson.

It depends on your judge. Given that it's been less than two months since the first incident (and I would assume just weeks or maybe even days since you entered your plea) your chances of going to jail go up substantially. Judges don't like to be duped.
