Legal Question in Criminal Law in Utah
I have a friend, 16 years of age, being accused of rape on a girl about his age as well, no older than 18. When he was first accused, he went to DT for the whole month of October, then was released but put on a type of house arrest. He's aloud to go places, as long as he has a guardian present. His next court date is this month sometime, near the center of the month. They will put him back in DT for 2 years if they find him guilty. Can they find him guilty if there is no proof of forced sex against this girl? or any proof in general?

He cannot be punished for the rape unless he is charged with the crime and convicted either by trial or by an admission of guilt.
