Sexual Harrassment / Unlawful Dismissal

I received a letter from my immediate supervisor, which was typed on his computer and then manually signed by him. For two years, I dealt with constant comments of a sexual nature. I kept telling myself he would stop if I ignored him. It drove me insane - I missed work, found ways to work out of my home and was very hostile in the work place. I was eventually fired at which time I came clean. The supervisor was dismissed and I was offered my job back. I could not return after all that had happened. Do I have a case against my former employer? My reputation in this small mining community it damaged beyond repair.

Your silence will probably hurt any case you might have had. If you had reported the harassment, and the company did nothing, then you would have had a good case. The fact that you did nothing, and when the company did discover the problem and they fired him and offered your job back indicates that the company did not support such behavior. It is not clear how your reputation is damaged, since the supervisor was fired and you were offered your job back.

You have 6 months from the date of termination to file your complaint with the EEOC and Utah Antidiscrimination Office. If you do not file within the 6 month period you lose any right to sue.
