Misdemeanor DUI (first and second DUIs) expire after 2 years, felony DUI (three +) expire after 4 years. Utah Code Ann. 76-1-302.

The information must have been filed within 2 years of the date of incident. If the Defendant is out fo the state during the 2 year period that may toll the statute of limitations. You need to look at when the infromation was filed and if it was signed.
