Legal Question in Elder Law in Utah

Grandma

My grandma's husband just resently passed away on the 25th. Can his kids legally kick her out of the house. It was his when they got married. They are saying that about five years ago they both signed papers on the deed to the house but we dont know what they are or what they say. Is there anything we can do. She is 82 years old.

Re: Grandma

The answer will depend completely on how the house is titled. Go down to the County Recorder's office for the county where the house is located, and get a copy of the last deed recorded. Once you have that, I can better answer your question. In general, though, if the house was titled in his kids' names, they can do what they want with the house. The deed will tell you exactly how the house was held, and I can better explain your rights with that information.
