Legal Question in Family Law in Utah

Almost 16 and visitation with Dad!

My daughter is almost 16 and She is starting to have her own schedules and school dances. We live about 90 miles from her dad. Her dad insists that when it is his weekend that she go with him, She does not like his girlfriend or the living arrangements. She just feels she is getting too old to go with dad. Is there an age limit when kids can decide when to go to dad's. I can't force her, yet she will me miserable if she is forced to go.

Re: Almost 16 and visitation with Dad!

The law requires that the custodial parent make the child available for visitation. If your 16 year old child does not want to go with her father, she should discuss this with him. She should be of an age to have this discussion with her father. You should not interfere, nor persuade her to not go with her father. As long as there is a court order in place requiring visitation any interference could be severely punished. You can ask for the court order to be changed, and the daughter's input would be considered.
