Abandonment

Three months ago I found out that my husband was cheating on me. When I confronted him, he walked out on me. He has continued to live somewhere else. He is unwilling to resolve the situation but contnues to leave his stuff here. I want to know if it is legally ok for me to move his stuff out. I've asked for him to get it, but he refuses. I don't want to be a storage unit forever. He refuses to let me have contact with him so I am unsure what to do.

Give him written notice (deliver when you see him - try to have a witness) that unless the property is removed within x days that you are going to dispose of it. You are part owner of his stuff and can dispose of it as you like. If you intend on getting a divorce or intend to sue for maintenance, you can make disposal of his property part of your lawsuit. I recommend that you at a minimum sue for maintenance, but not be in a hurry to get the divorce. You are probably entitled to alimony for the same number of years you were married. If you cannot contact him at all, then you can still file your suit, and have notice published in a newspaper. You may call for a free consultation.
