Legal Question in Family Law in Utah

adopting my step-son

My husband has full custody of his son (my step-son). A home study was done when the child was placed with us. My step-son's bio-mom is in prison for life and her family has no rights. I am interested in adopting him so that I can take care of him (medical, dental, etc) if my husband isn't available. Would we need another home study in this situation? How much would this type of adoption cost, and how long does it take? Are there any pros or cons that I should be aware of? We are also considering a durable POA for care of a child. Thank you.

Re: adopting my step-son

You should have no problems doing a step parent adoption, based on these facts. The cost should be modest as these things go. You will not need another home study. I cannot tell you about the negatives because I am not aware of all of the facts.

You can use a durable POA, and also should place your intentions for child care in your wills. The POA expires on your death.
