Legal Question in Family Law in Utah
Adoption reversed???
This is a situation where parents rights are in process of being terminated and children are in process of being adopted by adoptive/foster Parents. There are 3 children in question. Mother is herself adopted by biological grandmother, however grandmother has since passed away. Biological mother of mother losing parental rights wants to take the children in question, but she is not considered kin since she gave up rights of mother when she allowed grandmother to adopt. Can either biological mother or mother of children have previous adoption reversed for sake of establishing kinship? Please advise since this is what they are attempting.

Re: Adoption reversed???
Any "interested" party can object to an adoption. Interested parties include biological as well as adoptive relatives. The court looks at the best interests of the children to make the determination of whom shall be allowed to adopt. The question is not one of reversal of an adoption, but which family would be the better choice for the children.
