Adoptions

My daughter has just been sent adoption papers for her daughter. The document states that she gives up all of her parental rights. Her exhusband has agreed to send her a signed paper by himself and his wife stating the she will still have rights. If this is not part of the legal document, what will happen?

If your daughter waives all of her parental rights she will have no legal standing left in regards to her child. PERIOD. It is very risky to sign away rights relying on a later document - which may or may not come. If there is a "deal" all of the documents should be signed by both parties at the same time.

She should question why she is giving up legal rights to her child. I assume there is a bond between the child and your daughter, and this bond should NOT be terminated without clear and convincing cause. YOU DAUGHTER SHOULD TALK TO A LAWYER. This is not a decision which should be entered into without adequate counseling and legal advice. If she proceeds without clearly understanding the emotional and legal implications, the damage may not be able to be undone. If she wants to talk to me, I will give her a free consultation.
