Legal Question in Family Law in Utah

Age of childs choice

I have two children from a previous marriage. The ages are 10 and 14. The mother said she is going to get a order signed by a judge that gives the choice to the children whether or not they ''choose'' to come over on my visitation weekends. My question is at what age is this process allowed when there is no abuse or neglect on my part?

Re: Age of childs choice

General Rule One: Never believe the "enemy." In an adversarial relationship one should not rely on the "legal" conclusions asserted by your adversary. I doubt that the mother has a law degree. The law in Utah is that custody is determined by a test which reviews 8 or so factors which help determine what is in the best interests of the child. One of those factors is the desire of the child. It sounds like you are dealing with a controlling and manipulative person. You may want to consider having legal counsel assist you. You may call for a free consultation. (801) 876-4422
